CoinDesk recently interviewed Commissioner Summer Mersinger of the Commodity Futures Trading Commission (CFTC) regarding the question of who has the appropriate authority between the SEC and the CFTC. Commissioner Mersinger expressed her opinion, stating, “I believe it is definitely a question of who has the proper authority between the SEC and CFTC.” During the Consensus conference, Commissioner Peirce and I will be speaking together, as we share some similar viewpoints. However, there is a struggle because sometimes, in areas of contention, whether it is in enforcement cases or other actions related to fraud and manipulation enforcement authority that we have spoken about, we see the SEC starting to question as if it falls under their jurisdiction. Therefore, there is certainly some tension here. The main reason for this tension is the lack of clarity.
