Former chairman of the US Securities and Exchange Commission (SEC), Jay Clayton, believes that the approval of a spot Ethereum ETF is a positive sign for these products, stating that the approval of their registration statement and subsequent trading is “inevitable”.
However, Clayton points out that there are still challenging issues surrounding exchange-traded products and their underlying asset, Ethereum. He stated, “The SEC has not yet made a clear statement that the underlying transactions in Ethereum are not securities transactions.”
